Holmes’ bill requires that any dog that is tethered have access to water and shelter. The lead, which is the rope or chain used to tether the dog, must meet several requirements including length and weight restrictions, as well as be attached with a properly-fitting collar. The lead must also be in a location that prevents the dog from leaving the owner’s property. "Every year hundreds of dogs die from being tethered outside and being left unattended," Holmes said. "Many times it is because they are not given ample food and water or shelter from the elements. There are also cases of strangulation because of the quality of the lead. My bill will address these matters to ensure the health and safety of dogs that are tethered outside." The bill does have several exemptions built into it to accommodate special exceptions. Individuals who tether their dog while at an organized animal function such as hunting, obedience training, or law enforcement training will not be subject to the law. Farmers who tie up their dogs during the cultivation of agricultural products are also exempt. "This bill does not penalize responsible dog owners," Holmes said. "The purpose of this legislation is to crack down on mistreatment by owners who lack decency and compassion for their pets. Providing food, water, and shelter in a safe environment is not too much to ask." Current Illinois law does not include specific anti-tether legislation; however, if a tether resulted in an animal being unable to reach water and shelter or the tether causes injury, a humane care violation would result. Criminal penalties are in place for such violations.
SPRINGFIELD, IL – State Sen. Linda Holmes (D-Aurora) advanced a bill in the Illinois Senate this week that will greatly reduce the likelihood of canine neglect in Illinois. Senate Bill 2580 amends the Humane Care for Animals Act to define and outline guidelines for the tethering of dogs outdoors.
