Governor Signs Harmon Bill Adding ‘Life Penalty’ to Murderers of Medical Personnel

SPRINGFIELD, Ill. Governor Quinn yesterday approved a bill sponsored by State Senator Don Harmon (DOak Park) that paves the way for a murderer of a doctor, nurse, or other medical professional to be sentenced to natural life in prison.

 

"A natural life sentence in Illinois means a defendant will not leave prison until they die," Senator Harmon said. "If convicted, a murderer would never be eligible for parole or release of any kind. Our talented medical personnel deserve extra consideration when they are in harm’s way."

The bill, HB 5745, was initiated in the House by Representative Angelo Saviano (R-Elmwood Park), and in its original form would have made a defendant eligible for the death penalty for a murder conviction when the defendant knew the person was a physician, physician assistant, psychologist, nurse or advanced practice nurse and the offense occurred while the victim was performing his or her official duties, to prevent the performance of those duties or in retaliation for performing official duties.

"We have expanded eligibility for the death penalty many times, with little impact," Harmon explained. "Perhaps natural life imprisonment the ‘life penalty’ will be a more successful deterrent."

The law will take effect January 1, 2011. Current law specifies enhanced penalties when the victim is an emergency medical technician, paramedic, ambulance driver, or other medical assistance personnel; this bill extends the enhancement to the additional medical roles.
