Delgado: New law will further help to protect patients

SPRINGFIELD, IL Legislation sponsored by Illinois State Senator William Delgado (DChicago) which will allow the Department of Financial and Professional Regulation (IDFPR) to provide information to the public concerning complaints against Doctors or Medical Professionals.

"This is just one more tool that patients will be able to utilize when researching a doctor or other medical professional," stated Senator Delgado. "In addition, this legislation will bring additional disclosure when complaints are filed against doctors and hospitals."

House Bill 1476 will require IDFPR to disclose status of a pending complaint against a physician or other medical professional upon request. In addition, it requires the Department to notify the person who filed the complaint of the time and date of any hearing and whether or not they will be able to testify. The Department will have to send this notice in writing and at least 14 days prior to the hearing.

Currently, certain entities such as health care institutions and State’s Attorneys are required to report information to the Medical Disciplinary Board upon learning of a professional rule violation, but members of the public may also make complaints to IDFPR.

The time frame of these proceedings before this new law was 30 days to notify the person of a complaint against them, then another 60 to 180 days for the Board to file its initial recommendation.
